KARACHI: The Prime Minister’s Secretariat was making efforts to locate the whereabouts of missing citizens with
the assistance of law enforcement agencies (LEAs) concerned, Deputy Attorney General (DAG) told the Sindh
High Court (SHC) on Wednesday.

The court was hearing seven petitions against the alleged illegal detention of a number of people, including a
businessman and activists of political and religious organizations.

The missing persons are: Ali Mohammad (a religious scholar missing since May 5, 2004 from Gulshan-e-Iqbal
area), Mohammad Alim Tariq (a mosque Pesh Imam missing since December 17, 2005 from Gulshan-e-
Hadeed area), Munir Mengal (a TV director of the Baloch Voice channel missing since April 4, 2006 from Karachi
airport), Mumtaz Hussain (ex-Navy officer missing since July 3, 2006 from Karachi airport), President of
Balochistan National Movement, Quetta, Ghulam Nabi Baloch and Jamhoori Watan Party’s Sindh President Sher
Mohammad Baloch (missing since December 3, 2006, from Lyari area).

In all the petitions, the law enforcement agencies have been accused of arresting and illegally confining the said
persons. However, the LEAs have denied arresting or detaining the said missing persons.

DAG Akhtar Ali Mehmud requested adjournment on behalf of Attorney General of Pakistan, who was summoned
on the previous date of hearing to assist the court in detention cases, submitting that the AG was engaged in
some very important matter in Islamabad and prayed the court to fix the hearing for February 13 so that the AG
could appear and assist the court.

He assured the court that the government was giving utmost important to the cases of missing persons, adding
that the matter was being taken up at highest level.

Mr. Mehmud informed the court that cases of missing persons were also being taken up by the Supreme Court
and the hearing of such cases has been fixed for the first week of February. He submitted that after the SC takes
up the matter the federal government would be in a better position to apprise the court about the progress for the
recovery the missing persons.

Advocate General Sindh Anwar Mansoor Khan categorically denied that the said missing persons were detained
or arrested by any LEAs working under the control of the provincial government.

He informed the court that Mohammad Arif Kasmani, a businessman who was missing since November 29,
2005 from Karachi airport, has returned home.

Kasmani’s counsel Nihal Hashmi, however, expressed his reservation for withdrawing the petition, telling the
court that he would keep the matter alive as one detainee Saleem Baloch was re-arrested by LEAs within few
days of his release after 10-month detention.

Mr. Kasmani, who also appeared before the court, however, did not comment regarding his yearlong
disappearance.

Ali Mohammad’s counsel Chudhary Mohammad Iqbal submitted that no investigation was conducted with regard
to the abduction of his client despite the fact that an FIR had been registered in the police station concerned on
May 5, 2004.
AG Sindh assured the court that he would contact the investigation officer of the case for completing the
investigation.

Abdul Hafeez Lakho, Rasheed A Rizvi and Ms. Noor Naz Agha, appearing for other ىdetaineesî, submitted that
nothing was done by the provincial and federal governments for the recovery of the missing persons, which
shows inefficiency on the part of the LEAs.

SHC’s division bench comprising Chief Justice Sabihuddin Ahmed and Justice Faisal Arab also took notice of the
inefficiency of the police for failing to recover the missing persons.

Abdul Hafeez Lakho submitted that the family members of Munir Mengal were also compelled to withdraw
petition, assuring them that the detainee would be released if the petition was withdrawn from the
court. Criticizing the government for failing to recover the missing persons, he said the country seems to be ruled
under a civil martial law as nobody knows which authority was controlling the LEAs’ operations.

Ms. Noor Naz filed a fresh petition against the arrest of Saleem Baloch by LEAs. She submitted that Saleem was
released last month after 10-month detention but as soon he submitted an affidavit in the court, accusing LEAs of
arresting and detaining him without any charge, he was subsequently re-arrested and detained at an
undisclosed location. Later, the court adjourned the matter till February 13.

Balochistan HC moved on release of Mengal’s 14
missing associates  

QUETTA: Resident of District Lasbela Bashir Ahmed Mengal on Tuesday has moved Balochistan High Court
regarding release of fourteen missing associates of Sardar Akhtar Khan Mengal.  The fourteen missing persons
are Noor Ahmed s/o Abdul Karim, Amir Baksh, Haji Mengal, Zafar resident of Tehsil Wadh, District Khazdar,
Muhammad Abdullah resident of Tehsil Wadh, District Khazdar, Ghulam Haider, Haji Faujan, Abdul Khaliq and
others who are still missing.  It is pertinent to mention that Sardar Akhtar Jan Mengal is under house arrest since
November 28, 2006 at his residence, however Sardar Akhtar Jan Mengal’s fourteen associates are missing
despite passing of last many days.
